JAKARTA – PT Pertamina Hulu Rokan (PHR) has been slow for more than a year, to be precise since August 9, 2021 until now, to recover waste from Oil Contaminated Land (TTM) of hazardous toxic materials (B3) in the amount of about 10 million cubic meters in hundreds of locations in the WK. The Rokan Riau Oil and Gas Block, which is a legacy of PT Chevron Pasifik Inonesia (CPI) operations after receiving an assignment from SKK Migas since July 26, 2021, is suspect that PT PHR wants to embarrass President Jokowi at the upcoming G20 Summit forum in Bali.

“In fact, if referring to Article 424 of Government Regulation (PP) Number 22 of 2021 concerning the Implementation of Environmental Protection and Management, it is clearly ordered that B3 waste must be recovered immediately, it must not be more than 30 working days after it was found, if PT PHR is not able to appoint a third party. Third, to restore it, the Governor or Regent or Mayor can immediately appoint a third party at the expense of PT CPI and SKK Migas, “said Yusri.
Article 424 Government Regulation Number 22 of 2021 mandates ministers, governors, regents/mayors in accordance with their authority to determine third parties to restore environmental functions if the restoration of environmental functions as referred to in Article 415 does not begin to be carried out within a maximum period of 30 (thirty) ) days since the Environmental Pollution Control is carried out.
So, Yusri continued, his party indicated that the slow pace of PT PHR in carrying out the assignment from SKK Migas could be due to Buyung Jaffe’s weak leadership as President Director of PT PHR in controlling the supply chain function.
“Because the operational function is very dependent on the reliability of the supply chain function, including he is weak in dealing with negative interventions from stakeholders and it is complete that he has never had experience in leading a production field like the Rokan Block,” explained Yusri.
The reason is, Yusri continued, if according to the Head of Agreement (HoA) on September 28, 2020 which was signed by the Head of SKK Migas Dwi Sutjipto with the President Director of PT Chevron Pasifik Indonesia Albert Simanjuntak at the SKK Migas office, after PT CPI deposited USD 265 million from the lifting proceeds. oil in the SKK Migas escrow account according to the profit sharing split of 88: 12 (GOI: CPI), then the HoA has released PT CPI from all obligations for the recovery of millions of cubic meters of TTM B3 waste in the Rokan Block.
“As for the value of PT CPI’s obligations of even that amount from the start, we really questioned it, considering the calculations from the results of the environmental audit by the Minister of Environment and Forestry Siti Nurbaya, the volume of TTM B3 waste was found to be more than 6 million cubic meters, excluding dozens of production facilities that had to be restored by PT CPI. according to the order of PTK 040/2018/SO derived from the Minister of Energy and Mineral Resources Regulation number 15 of 2018 concerning Post-operation Activities,” said Yusri.
Unfortunately, Yusri continued, since being sued by the Indonesian Forest Destruction Prevention Agency (LPPHI) on July 6, 2021 at the Pekanbaru District Court, the Ministry of LHK as Defendant III seems to have deliberately concealed the results of the environmental audit of the Rokan Block, despite the orders of Article 50 of Law No. Number 32 of 2009 concerning PPLH, the Minister of LHK is obliged to open environmental audits to the public, so that hiding the results of environmental audits raises a big question mark what is wrong with KLHK.
“Considering, the Request For Information (RFI) issued by PT PHR for the selection of partners who will be appointed as candidates for implementing waste recovery, from many items of activity at RFI, there is a need for companies with delineation expertise, so we suspect the volume of environmental audit results that are used as the basis for The HoA between SKK Migas and PT CPI is based on guesswork about the volume of waste, if true, this is dangerous and has the potential to harm the state,” Yusri explained.
It should be noted, said Yusri, that the signing of the HoA at that time between SKK Migas and PT CPI was also witnessed by Coordinating Minister for Maritime Affairs Luhut Binsar Panjaitan and Minister of Energy and Mineral Resources Arifin Tasrif and Director General of PSLB3 KLHK Rosa Vivien Ratnawati.
“Well, if the Director General of PSLB3 Rosa Vivien Ratnawati has been appointed by the Pertamina Board of Directors to be the President Commissioner of PT Pertamina Hulu Rokan, but she is not able to beautify the Rokan block environment, only able to beautify herself, is this not a reckless appointment?” said Yusri.
Therefore, said Yusri, if SKK Migas and KLHK do not want to be called compact and want to embarrass President Jokowi, immediately write a letter to the Minister of SOEs and Pertamina’s Board of Directors to evaluate the Directors of PT PHR. (CERI/YU)
